Customer Agreement
To ensure the best and most reliable service for all of our customers,
HavenCo may impose reasonable rules and regulations regarding the use of its
services. Such rules and regulations constitute the HavenCo Acceptable Use
Policy and the most current version can always be found at
http://www.havenco.com/legal/aup.html.
This document may change from time to time. Changes go into effect and are
applied to all customers from the time that they are posted to the above URL.
Servers hosted with the HavenCo network may be open to the public. The
customer is solely responsible for usage of the HavenCo network and any data
made publicly available on servers hosted within the HavenCo network may be
deemed a "publication" of the information entered.
Unacceptable use of the network includes, but is not limited to:
Bulk or regular unsolicited communications through email or other
Internet protocol. (commonly called "spam") Hosting web content
which is knowingly advertised by spam is also prohibited. Mailing lists
must comply with the MAPS Mailing
List Management Guidelines; they must be opt-in, provide confirmation
protection against accidental or malicious subscription, terms of
use of address use must be fully disclosed, and unsubscription methods
must be provided.

Attempts to use HavenCo services to compromise the security or
tamper with system resources or accounts on computers at HavenCo or at
any other site ("hacking"). Examples of these attempts are port
scanning, ping
flooding, password guessing, sniffing network segments containing
machines other than your own, or exploiting "backdoors"/security
vulnerabilities to gain unauthorized access to accounts, resources, or
machines.
Unacceptable publications include, but are not limited to:
Material that is unlawful in the jurisdiction of the server.
For instance, if a customer's machine is hosted on Sealand by HavenCo,
content which is illegal in Sealand may not be published or housed on that
server. Sealand's laws prohibit child pornography. Sealand currently has
no regulations regarding copyright, patents, libel, restrictions on
political speech, non-disclosure agreements, cryptography, restrictions on
maintaining customer records, tax or mandatory licensing, DMCA, music
sharing services, or other issues; child pornography is the only content
explicitly prohibited. At the present time, child pornography is
not precisely defined; HavenCo is obeying rules similar to those of the
United States, specifically a prohibition on any depiction of those under
18 in a sexual context.
HavenCo will not necessarily attempt to police or monitor the use of the
network, or the content of publications originating from our customers
servers. However, should we become aware of network usage or publication of
content that violates our policies, we may suspend or terminate service to
the customer. It is our policy to notify customers of such violations and
give them a reasonable period to comply before taking any action, however,
in the case of flagrant or repeated violations we may choose to suspend or
terminate services immediately without any advanced notification.
In the event a customer is believed to have violated this AUP, HavenCo reserves
the right to suspend the customer's network traffic at the router level
while HavenCo conducts an investigation into the believed AUP violation.
If a customer is found to have violated the AUP, HavenCo reserves the right to
take appropriate action, possibly including permanent filters on a customer's
network connection (inbound/outbound mail and web), disconnection, and
recovery of costs related to the AUP investigation from the customer prior to
return of customer equipment or remaining credit balance. HavenCo also
may turn over the results of an AUP violation investigation to law enforcement,
other network administrators, or others.
